DogManny.com - Terms of Service

Effective Date: [April 1st, 2025]

By booking any dog walking, sitting, boarding, or related pet care services ("Services") through DogManny.com ("Company," "we," or "us"), you ("Client") agree to the following legally binding terms and conditions:

1. Eligibility & Representations

Client affirms they are the lawful owner or authorized agent of the pet(s) receiving care. Client represents that all information provided to Company is accurate, including pet behavior, medical conditions, and special needs.

2. Assumption of Risk & Release of Liability

Client acknowledges that pet care involves inherent risks. By using our Services, Client voluntarily assumes all risks of damage or injury to their pet(s), themselves, third parties, or property.

To the fullest extent permitted by law, Client releases and holds harmless DogManny.com, its owners, employees, contractors, and affiliates from any claims, damages, losses, or expenses (including veterinary or legal costs) arising from:

  • Injury, illness, or death of pet(s);

  • Injury caused by pet(s) to others or to property;

  • Escape, behavioral incidents, or property damage;

  • Unforeseen events including emergencies, theft, or acts of God;

  • Acts or omissions of independent contractors.

3. Medical Care

In the event of illness or injury, Company may seek veterinary care at Client’s expense. We will make reasonable efforts to contact Client beforehand. Client agrees to reimburse all medical costs and releases Company from liability for decisions made in good faith.

4. Aggression, Behavioral Risks & Emergency Removal

If a pet displays aggression or behavior that endangers itself, people, or other animals, Company may terminate Services or arrange alternative care at Client’s expense. Company reserves the right to permanently refuse service to pets deemed unsafe.

5. Cancellations, Refunds & Payment

Payment is due upon completion of Services, unless otherwise agreed in writing or via text.
Overnight sitting reservations are subject to a 50% cancellation fee if canceled within 10 calendar days of the scheduled start date.
No refunds will be issued once Services begin.

6. Property Access & Security

Client authorizes Company to access their property for scheduled Services. Client affirms the premises are secure and safe for entry. Company is not liable for theft, damage, or incidents involving access issues, alarms, or unsafe property conditions.

7. Photos, Media & Marketing

Client grants permission for Company to photograph or record pet(s) during care for promotional, marketing, or documentation purposes. No compensation will be provided.

8. Independent Contractors

Company may use vetted independent contractors. Client agrees Company is not liable for acts or omissions of such contractors provided they act within the scope of work assigned.

9. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Texas. Any dispute shall be resolved through binding arbitration in Travis county, Texas under American Arbitration Association rules. Parties waive the right to a jury trial.

10. Entire Agreement

This Agreement constitutes the full understanding between Client and Company, superseding all prior discussions. No changes are valid unless made in writing and signed by both parties.

By booking any Services, Client affirms they have read, understood, and agreed to these Terms of Service.
